Criminal Defense

The pressure to arrest and convict offenders is enormous. Laws have become increasingly tough. This pressure has clouded a fundamental issue in our democratic society:

The presumption of innocence and proof beyond a reasonable doubt. Without an experienced and committed lawyer by your side, your legal rights can easily be overlooked as law enforcement and courts demonstrate to elected officials an increase in convictions. Without a solid defense strategy, you could become just a statistic. The Don Turner Legal Team is accomplished and experienced in DUI and criminal defense.

Don’t Gamble With Your Rights – Call a Georgia Criminal Defense Attorney

We are committed to the vigorous defense of people accused of serious crimes and are proud of our record serving clients. We will leave no stone unturned to ensure that your constitutional rights are protected. We represent clients accused of misdemeanors and felonies, including:

Appeals

If you have been unjustly convicted or sentenced, then you need an experienced appeals attorney who can get your decision reversed. Our legal team handles multiple appeals cases, namely habeas petitions, Georgia criminal appeals, and federal criminal appeals. We can guide you through the appeals process and answer any questions you may have.

Assault and Battery

Assault and battery are serious charges in Georgia. You can be charged with simple battery merely by touching someone without permission, and you can be charged with simple assault if the mere threat of harm is present. Simple assault and battery are considered misdemeanors punishable with up to 12 months in jail. Aggravated assault and battery, which may involve the use of a weapon or the intent to commit a crime, are considered felonies punishable by up to 20 years in prison. We can help get these charges reduced or even dismissed entirely.

Civil Forfeiture

You’re expected to call the police when your property is taken. But who do you turn to when the police take your property? Believe it or not, this happens all the time, as part of a practice called civil forfeiture. The recent Supreme Court case Timbs v. Indiana has made it harder for law enforcement to seize and keep your property. Even then, many people do not know how to get their property back. We can help you protect what’s yours from wrongful civil asset forfeiture.

Drug Offenses

Although drug charges can be prosecuted as either a felony or a misdemeanor, the jail time and fines involved are often substantial. If you have been charged with a drug-related crime, such as possession, drug trafficking, or prescription fraud, then you should contact us immediately. We have the experience you will need to fight your charges.

Forgery

Forgery is the creation or possession of a document that is not what it seems to be. For example, if you were in possession of a passport that was not issued by the government, then you could be brought up on forgery charges. The severity of a forgery charge can range from a misdemeanor to a felony but they should never be taken lightly. If you have been charged with forgery then you need to contact one of our criminal defense attorneys immediately to protect your interests.

Fraud

Identity fraud is the act of opening a bank account or credit card in someone else's name, selling or transferring someone's identifying information (such as their social security number) or using someone's bank account or credit card without their permission. If you have been charged with identity fraud in Georgia, then you will need an attorney with years of experience in the federal court system to help you win your case. Our legal team is standing by to help.

Murder and Manslaughter

Murder is arguably the most serious crime you can be charged with, and the outcome of a murder case can have a huge impact on your future. The most severe charge, first-degree murder, is punishable with life in prison or even the death penalty, while the least severe, involuntary manslaughter can be punished with up to ten years in custody. Don't settle on a general practice lawyer for your murder case. You need the expert help of a lawyer who can come up with a winning strategy for your case, ensuring you have the best defense available.

Parole and Probation Violations

There are many things that can trigger a parole or probation violation, from failing a drug test to not getting or keeping a steady job. While a parole or probation violation might not seem like a big deal, it can result in you losing your freedom. You need an attorney who can ensure you will stay out of jail. Don Turner was a Probation Officer for many years and knows the system. We do not take a "one size fits all" approach to your case and will tailor our methods to your specific situation.

Racketeering

In the past, the Racketeer Influenced and Corrupt Organizations Act (RICO) was simply a tool to take down organized crime. Now its scope has expanded to include much more. Now, if you commit two or more illegal activities to fund a criminal organization within ten years, you can be brought up on RICO charges. If convicted, you can be heavily fined and spend years in jail. To properly argue your case, you will need an attorney with extensive knowledge of the Georgia RICO act and the experience that comes with years of trying these cases. Our attorneys have the skills you need.

Sex Crimes

Being charged with sexual assault or other sexual offenses can have long-reaching consequences, whether the charges are true or not. If you are charged with a sex crime, you could face extended jail time, harsh monetary fines, and being ostracized from your community. You may even be forced to register your name and information with state and local sex offender registries. To avoid the social stigma, fines, and possible jail time, you need expert counsel from a lawyer with years of experience with sex offense cases. We can give you the protection you need.

Theft

Theft may seem like an unimportant charge because people mainly think of shoplifting or pickpocketing but it can be quite serious. Theft can be a misdemeanor charge if the value of the item is less than $500, but a conviction on your record could be more detrimental than you realize. If you want your charges reduced or dismissed, you need an experienced criminal defense lawyer. Even misdemeanors can have stiff consequences if you don’t have someone protecting your rights.

Vehicular Homicide

Under Georgia law, vehicular manslaughter is taken very seriously. Depending on the details of your case, it could be seen as either a misdemeanor or a felony and you don’t want to leave that choice up to the prosecutors. You will need help from a vehicular homicide attorney to make sure you have adequate protection and you should contact one as soon as possible.

Juvenile Offenders

Most of us got in a little trouble when we were young. However, without proper representation, the repercussions of a criminal conviction could follow your child into adulthood. To properly protect their rights and guide them through the juvenile court system, you will need assistance from an experienced juvenile defense attorney like Don Turner, who worked extensively in the juvenile court system. Our legal team can watch over your child through every step of the process and make sure they have the guidance and protection they need. Our criminal defense lawyers will aggressively fight for each minor’s rights.
