Is .08% blood alcohol content the golden rule when it comes to legal intoxication?

Most states do use .08% as a guideline but it depends on your age as well. If you are:

  • Under 21 years of age the limit is .02%
  • 21 or older the limit is .08%
  • A commercial driver the limit is .04%

How extreme are the penalties if you are a multiple offender?

The main things that will change depending on your past offenses are how long you will lose your license for, how much you will have to pay in fines and how long you may have to be in jail. It breaks down like this:

  • If it is your third DUI in ten years then the minimums will be 15 days in jail, a 1,000$ fine, and 5 years of license suspension
  • If it is your fourth DUI in ten years then the minimums will be one year in jail, a 1,000$ fine and indefinite license suspension
