J.K. (Felony Drug)
Our client was facing felony heroin possession charges in Cobb County Superior Court. We knew we could prove the drugs belonged to a passenger, a young man that he had been trying to mentor. He was petrified. Trying to help someone was about to land him in jail, cost him his job of 20 years, and time with his children. As soon as we met with our client, we requested he obtain a Drug and Alcohol Evaluation and to get weekly drug testing to show that he is not a user and has no substance abuse issues. This proactivity assisted us in finalizing his case without a trial. We met with the District Attorney's Office with evidence in his defense and in lieu of going through a Motions hearing and a Jury Trial, where the outcome is never completely predictable, he happily agreed to plead guilty to a reduced charge of Misdemeanor Disorderly Conduct.
