What is Drug Trafficking?

A general definition would be the illicit cultivation, manufacturing, distribution and sale of any substance that is subject to drug prohibition laws. It has always carried harsh penalties but Georgia's drug trafficking laws and penalties are often more severe than other serious crimes.

The minimum sentences for drug trafficking in Georgia depends on the type of drug and the amount involved:

  • Cocaine Trafficking – You are guilty of trafficking cocaine when you are found selling, manufacturing, delivering or possessing a minimum of 28 grams of cocaine. For 28 grams up to 200 grams, you will receive a mandatory 10 years in prison. 200 to 400 grams will get a mandatory 15 years in prison and more than 400 grams carries a minimum sentence of 25 years imprisonment.
  • Morphine and Opium Trafficking – You are guilty of trafficking when you are found selling, manufacturing, delivering or possessing a minimum of 4 grams of these drugs. 4 to 14 grams will result in a mandatory 5 year prison sentence. Quantities between 14 and 18 grams will carry a 10 year prison term and 28 grams or over will result in at least 25 years in prison.
  • Marijuana Trafficking – You are guilty of trafficking when you are found selling, manufacturing, delivering or possessing a minimum of 10 pounds of marijuana. 10 to 2,000 pounds will result in a mandatory 5 year prison sentence. Quantities between 2,000 and 10,000 pounds will carry a 7 year prison term and 10,000 pounds or over will result in at least 15 years in prison.
  • Methamphetamine or Amphetamine Trafficking – You are guilty of trafficking when you are found selling, manufacturing, delivering or possessing a minimum of 28 grams of these drugs. 28 to 200 grams will result in a mandatory 10 year prison sentence. Quantities between 200 and 400 grams will carry a 15 year prison term and 400 grams or over will result in at least 25 years in prison. There are separate penalties for manufacturing these drugs which are the same as those listed above but any amount over 200 grams must receive at least a 10 year prison sentence.
