Defendant's Rights

Right to a Criminal Defense Attorney

You have the right to a criminal defense attorney throughout your criminal proceedings.  If you cannot afford an attorney, in many cases, the court will provide an attorney for you if you qualify.

Right to a Jury Trial

In felony and serious misdemeanor cases, you have a right to a speedy, public jury trial. In other misdemeanor cases, you have a right to a trial with a judge. In any trial, you are presumed innocent and cannot be convicted until the jurors (or judge) are convinced of your guilt beyond a reasonable doubt.

Right to Confront Witnesses

You have a right to confront and cross-examine all witnesses testifying against you in court. If witnesses do not appear in court, the state might dismiss your case.  You also have the right to use the subpoena powers of the court to compel witnesses to appear on your behalf.

Right Against Self-Incrimination

You have the right to remain silent and not incriminate yourself. You also have the right to testify on your own behalf. If you choose not to testify, neither the court nor jury can hold this against you.

Right to Produce Evidence

You have the right to present evidence and to have the court issue a subpoena to bring into court all favorable witnesses and evidence at no cost to you.

What Can I Expect in a Criminal Case?

Going before a judge and jury is a nerve-wracking and new experience for the majority of our clients and many do not know what will happen to them following their arrests. The Don Turner Legal Team understands and has accordingly made a short and sweet guide to criminal trials, which proceed much differently than civil lawsuits.

First, a criminal case can take on a couple of different forms, as there are two major classifications of crime: misdemeanors and felonies. They are both outlined within the basic structure listed within the What to Expect When You're Litigating (A Criminal Case.)
